Xypheron may use encryption, security tooling, access controls, and privacy-focused design. However, no digital system, software, network, storage layer, device, transmission route, or cryptographic implementation can be guaranteed to be completely secure, uninterrupted, or invulnerable.

Where required by law, marketing communications will only be sent in accordance with your preferences and applicable rules. You can unsubscribe from non-essential marketing communications using the methods provided.
We may update, modify, suspend, restrict, or discontinue any part of Xypheron at any time, including features, pages, layouts, modules, integrations, technical configurations, pricing, and access levels.
We do not guarantee that the platform will always be available, uninterrupted, error-free, or compatible with all devices, browsers, operating systems, networks, or third-party tools.
Scheduled maintenance, emergency updates, security patches, outages, telecom failures, infrastructure events, force majeure events, or third-party failures may affect availability without liability to us.
Xypheron may interoperate with or link to third-party tools, hosts, libraries, APIs, payment processors, telecom services, email providers, cloud services, analytics providers, or external websites.
We do not control and are not responsible for third-party services, their content, security, uptime, privacy practices, accuracy, or terms. Your use of such services is subject to their own terms and policies.
All rights, title, and interest in and to Xypheron, including its software, source code, object code, interface design, layout, workflows, branding, logos, names, databases, documentation, graphics, text, compilations, trade dress, infrastructure, systems, and all related intellectual property rights, are and shall remain owned by Xypheron, SMG, and/or our licensors.
Except for the limited right to use the services in accordance with these Terms, nothing in these Terms grants you any ownership interest, licence, or right to exploit any of our intellectual property.
You must not copy, reproduce, sell, lease, distribute, white-label, modify, adapt, frame, mirror, republish, or create derivative works from any part of the platform except where we expressly permit this in writing.
If you provide suggestions, ideas, recommendations, feature requests, bug reports, or other feedback relating to Xypheron, you agree that we may use that feedback without restriction, acknowledgement, payment, or obligation to you.
We may suspend, restrict, investigate, or terminate your access immediately, with or without notice, if we reasonably believe that:

Xypheron is a communications and productivity platform. It is not a law firm, bank, regulated financial service, medical service, emergency service, archival guarantee, or guaranteed disaster-recovery platform.
Any information made available through the platform is for general informational or operational use only and does not constitute legal, financial, medical, tax, compliance, security, or other professional advice.
To the fullest extent permitted by law, the services are provided on an “as is” and “as available” basis.
We disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, availability, accuracy, and uninterrupted operation.
We do not warrant that:
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that the law does not permit to be excluded.

You must not use, export, re-export, provide, or make available Xypheron or any related software, technology, or service in breach of applicable export-control laws, sanctions regimes, trade restrictions, anti-boycott laws, or similar regulations.
You represent that you are not located in, ordinarily resident in, or acting on behalf of any person, entity, or territory subject to applicable restrictions that would make provision of the service unlawful.
If you use Xypheron under a business, team, admin-managed, or organisation account, the account owner or designated administrators may have rights to manage users, settings, retention rules, data access levels, project areas, billing, and service configurations associated with that workspace or package.
You acknowledge that administrators may be able to control or restrict access to content and features within organisation-managed environments.
If you believe content, conduct, or account activity on Xypheron breaches these Terms, infringes rights, or presents a security concern, you should report it using the contact details or reporting methods provided on the platform.
We may investigate reports but are not obliged to take any specific action unless required by law or our internal policies.
We may amend these Terms from time to time to reflect changes in law, regulation, security requirements, platform features, technical design, commercial structure, or service operations.
Where appropriate, we may provide notice by posting the updated version on the website, through your account, or by other reasonable means. The “Last updated” date above will also be revised.
Your continued use of Xypheron after updated Terms take effect constitutes acceptance of the revised Terms.
These Terms and any non-contractual obligations arising from or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute, claim, or matter arising out of or in connection with these Terms or the services, unless mandatory law in your place of residence requires otherwise.
Xypheron may provide APIs, custom integrations, or connection points for certain users, business clients, or approved third-party systems. Any such access is granted on a limited, revocable, non-exclusive basis and remains subject to these Terms.
Xypheron may include AI-assisted, automated, or machine-supported features for productivity, analysis, organisation, communication support, or related purposes. These features are provided for convenience only.
You agree not to disclose, publish, misuse, or exploit non-public information relating to Xypheron’s infrastructure, internal systems, security architecture, development methods, technical weaknesses, vulnerabilities, processes, internal documentation, or confidential business information.
We may use backup, replication, recovery, failover, or redundancy systems to help support service continuity. However, no backup or recovery system is guaranteed to preserve, restore, or reproduce all data accurately or in full.
Payments may be processed through third-party gateways, providers, processors, acquirers, or billing platforms. Your use of any payment functionality may also be subject to the separate terms of those providers.
We are not responsible for any delay, interruption, non-performance, degradation, or failure caused directly or indirectly by events beyond our reasonable control.
These Terms, together with any policies, notices, additional service terms, business agreements, and documents expressly incorporated by reference, constitute the full and entire agreement between you and Xypheron regarding the platform and supersede any prior discussions, understandings, representations, or agreements relating to the same subject matter.
If any provision of these Terms is found by a court or competent authority to be unlawful, invalid, or unenforceable, that provision shall be severed or interpreted to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
No delay, omission, or failure by us to enforce any right, power, remedy, or provision under these Terms shall operate as a waiver of that right or any other right, nor shall any single or partial exercise of any right prevent further exercise of it.
